These Terms of Service ("Terms") govern your use of ETIGuard, an email security service provided by Exodus Telecom Inc. ("ETI", "we", "us", or "our"), a corporation incorporated in Ontario, Canada, holding CRTC BITS Licence #8190-E126-202600642.
By creating an account or using ETIGuard, you agree to be bound by these Terms. If you do not agree, do not use the service.
ETIGuard is an inbound email filtering and security platform that protects your domains from spam, malware, phishing, and other unwanted email. The service processes inbound email on your behalf and delivers clean messages to your designated mail server.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials. You must be at least 18 years of age to use this service. Accounts are non-transferable.
You agree not to use ETIGuard to:
ETIGuard processes your inbound email for the purpose of spam and malware filtering. Email content is temporarily stored for up to 30 days to enable quarantine review and message recovery. We do not sell, share, or use your email content for any purpose other than providing the filtering service.
We are committed to compliance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). You have the right to access, correct, and request deletion of your personal information. Please see our Privacy Policy for full details.
We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for email delivery failures, delays, or losses resulting from service interruptions, network issues, or circumstances beyond our reasonable control.
New accounts require a valid payment method to start a 30-day trial. During the trial period, full service features are available at no charge, and no payment is collected until the trial ends. You may cancel at any time before the trial ends via your account's billing management page to avoid being charged. We reserve the right to modify trial terms with reasonable notice.
Following the free trial period, continued use of ETIGuard requires a paid subscription. Pricing is as listed on our pricing page. All prices are in Canadian dollars and are subject to applicable taxes including HST where applicable.
You may cancel your account at any time through your account settings. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your data will be retained for 30 days before permanent deletion.
To the maximum extent permitted by applicable law, Exodus Telecom Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of ETIGuard. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
We may update these Terms from time to time. We will notify you of material changes by email. Continued use of the service after changes constitutes acceptance of the updated Terms.
